TERMS OF USE, SALES TERMS, WARRANTY, AND LEGAL NOTICE

Welcome to RetrofitSupercharger.com (the “Site”), owned and operated by Retrofit Supercharger, LLC (“Retrofit Supercharger,” “Company,” “we,” “us,” or “our”).

By accessing, browsing, purchasing from, or otherwise using this Site, you agree to be bound by these Terms of Use, Sales Terms, Warranty Terms, and all applicable laws and regulations. If you do not agree to these terms, do not use this Site or purchase products from us.

Retrofit Supercharger, LLC reserves the right to modify these Terms at any time without prior notice. Changes become effective upon posting to the Site.

2. ELIGIBILITY AND ACCEPTANCE OF TERMS

By using this Site or purchasing products from us, you represent and warrant that:

You are at least 18 years of age.
You have the legal capacity to enter into a binding agreement.
You will use the Site in compliance with all applicable laws and regulations.

3. PRODUCTS AND AVAILABILITY

Retrofit Supercharger, LLC sells:

Supercharger kits
Supercharger-related components and replacement parts
Supercharger covers
Branded sticker packs
Related accessories

All product descriptions, specifications, pricing, photographs, and availability are subject to change without notice.

We reserve the right to discontinue any product at any time.

Product photographs may differ slightly from final production products due to manufacturing updates, improvements, lighting, display settings, or supplier changes.

4. OFF-ROAD USE ONLY

Unless expressly stated otherwise, performance products sold by Retrofit Supercharger, LLC are intended for off-road use only.

Many aftermarket automotive performance products may not comply with federal, state, or local emissions regulations.

It is the customer’s sole responsibility to determine whether a product is legal for use, installation, or operation in their jurisdiction.

Retrofit Supercharger, LLC makes no representation that any product complies with emissions, inspection, registration, or road-use requirements in any state, province, or country.

5. CALIFORNIA SALES RESTRICTIONS

Retrofit Supercharger, LLC does not sell or ship supercharger kits or engine-related performance components to California.

The following products may be sold and shipped to California:

Sticker packs
Apparel (if offered)
Supercharger covers and cosmetic accessories that are not engine components and are not installed on a vehicle’s engine

We reserve the right to refuse or cancel any order that violates this policy.

6. ORDER ACCEPTANCE

Receipt of an order confirmation email does not constitute acceptance of an order.

Retrofit Supercharger, LLC reserves the right to:

Refuse service to anyone.
Limit quantities.
Cancel orders.
Require identity verification.
Require additional payment verification.

If an order is canceled after payment has been received, a refund will be issued using the original payment method, less any non-refundable processing costs where permitted by law.

7. PRICING ERRORS

Despite our best efforts, products may occasionally be listed with incorrect pricing or information.

Retrofit Supercharger, LLC reserves the right to refuse, cancel, or correct any order containing pricing, specification, inventory, or typographical errors, regardless of whether payment has been received.

8. ALL SALES ARE FINAL

ALL SALES ARE FINAL.

Retrofit Supercharger, LLC does not accept returns, exchanges, or refunds except as expressly required by law or covered under the Limited Warranty described below.

By placing an order, the customer acknowledges and agrees that:

Products are purchased at the customer’s own discretion.
Product compatibility has been independently verified by the customer.
Customer remorse, change of plans, project cancellation, inability to install, vehicle sale, or incorrect ordering does not qualify for a refund.

Custom-built, made-to-order, modified, special-order, discontinued, clearance, or promotional products are non-refundable and non-cancellable.

9. SHIPPING AND DELIVERY

Shipping dates are estimates only.

Retrofit Supercharger, LLC shall not be liable for delays caused by:

Suppliers
Manufacturers
Carriers
Customs authorities
Weather events
Labor shortages
Acts of God
Government actions
Circumstances beyond our reasonable control

Risk of loss transfers to the customer upon delivery to the shipping carrier.

Customers are responsible for providing accurate shipping information.

10. INTERNATIONAL SALES AND SHIPPING

Retrofit Supercharger, LLC primarily serves customers within the United States.

International sales and shipments may be available on a case-by-case basis where permitted by applicable laws, regulations, export restrictions, carrier limitations, and product-specific requirements.

Customers residing outside the United States who wish to purchase products should contact us prior to placing an order at:

to determine whether shipment to their country or region is available.

Retrofit Supercharger, LLC reserves the sole right to refuse international sales or shipments for any reason, including but not limited to legal restrictions, import regulations, sanctions, carrier limitations, product restrictions, fraud concerns, or logistical constraints.

International customers are solely responsible for:

Compliance with local laws and regulations
Import permits and approvals
Customs clearance
Duties and taxes
Brokerage fees
VAT, GST, or similar taxes
Product legality within their jurisdiction

Retrofit Supercharger, LLC makes no representation that any product complies with the laws, regulations, emissions requirements, or vehicle standards of any country outside the United States.

Any product refused, seized, delayed, destroyed, or returned by customs authorities or governmental agencies shall remain the sole responsibility of the customer.

Shipping charges, duties, taxes, brokerage fees, and customs-related expenses are non-refundable.

11. INSTALLATION RESPONSIBILITY

Retrofit Supercharger, LLC strongly recommends professional installation.

Customers assume all risks associated with:

Installation
Tuning
Vehicle modification
Vehicle operation
Maintenance
Product misuse

Improper installation may result in vehicle damage, personal injury, property damage, emissions violations, or loss of vehicle warranties.

The customer assumes full responsibility for ensuring proper installation and operation.

12. LIMITED WARRANTY

Retrofit Supercharger, LLC warrants that components manufactured by Retrofit Supercharger, LLC will be free from defects in materials and workmanship for a period of one (1) year from the original purchase date.

This warranty applies only to the original purchaser and is non-transferable.

Warranty Coverage

At our sole discretion, we may:

Repair the defective component;
Replace the defective component; or
Provide a replacement part of equivalent value.

Warranty Exclusions

This warranty does not cover:

Improper installation
Abuse
Negligence
Racing damage
Competition use
Overheating
Detonation
Improper tuning
Lack of maintenance
Accidents
Unauthorized modifications
Cosmetic defects
Normal wear and tear
Damage caused by unrelated vehicle failures

The warranty applies only to the specific manufactured component found defective and does not cover labor, shipping, towing, rental vehicles, loss of use, lost profits, or damage to any other component.

13. DISCLAIMER OF WARRANTIES

EXCEPT FOR THE EXPRESS LIMITED WARRANTY ABOVE, ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RETROFIT SUPERCHARGER, LLC DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
COURSE OF DEALING
COURSE OF PERFORMANCE

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RETROFIT SUPERCHARGER, LLC SHALL NOT BE LIABLE FOR:

INDIRECT DAMAGES
INCIDENTAL DAMAGES
SPECIAL DAMAGES
EXEMPLARY DAMAGES
PUNITIVE DAMAGES
CONSEQUENTIAL DAMAGES
LOST PROFITS
LOST REVENUE
LOSS OF BUSINESS
LOSS OF DATA
VEHICLE DAMAGE
PERSONAL INJURY
PROPERTY DAMAGE

WHETHER ARISING IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, OR OTHERWISE.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

15. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Retrofit Supercharger, LLC and its owners, officers, employees, contractors, and affiliates from any claims, liabilities, damages, losses, costs, or expenses arising from:

Your use of the Site
Your installation or use of products
Violation of these Terms
Violation of any law or regulation
Damage caused to third parties

16. INTELLECTUAL PROPERTY

All content on this Site, including:

Text
Graphics
Logos
Product designs
Photographs
Videos
Documentation
Software
Branding

is the exclusive property of Retrofit Supercharger, LLC or its licensors and is protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed, modified, or used without prior written permission.

17. PROHIBITED USES

You may not:

Interfere with Site operations
Attempt unauthorized access
Use automated scraping tools
Reverse engineer proprietary products
Misrepresent your identity
Violate any applicable law

We reserve the right to terminate access without notice.

18. EXTERNAL LINKS

The Site may contain links to third-party websites.

Retrofit Supercharger, LLC does not control or endorse third-party websites and is not responsible for their content, products, services, or privacy practices.

19. FORCE MAJEURE

Retrofit Supercharger, LLC shall not be liable for any failure or delay resulting from events beyond its reasonable control, including acts of God, natural disasters, labor disputes, supplier shortages, transportation interruptions, cyberattacks, government actions, pandemics, or utility failures.

20. DISPUTE RESOLUTION, PRE-SUIT NOTICE, AND ATTORNEY’S FEES

Mandatory Pre-Suit Notice

Before initiating any arbitration, lawsuit, claim, charge, complaint, or other legal proceeding against Retrofit Supercharger, LLC, the customer must provide written notice describing the dispute in reasonable detail.

Such notice must be sent via certified mail or nationally recognized overnight carrier to:

Retrofit Supercharger, LLC shall have thirty (30) days from receipt of such notice to investigate and attempt to resolve the dispute.

Failure to provide the required pre-suit notice shall constitute a material breach of these Terms and may be grounds for dismissal, stay, or other appropriate relief.

Binding Arbitration

Except as otherwise provided herein, any dispute, claim, controversy, or cause of action arising out of or relating to:

These Terms;
The Site;
Any order;
Any product;
Any warranty claim; or
Any interaction with Retrofit Supercharger, LLC

shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules.

The arbitration shall take place in Fairfield County, Connecticut, unless otherwise agreed in writing by the parties.

The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of these Terms.

Class Action Waiver

To the fullest extent permitted by law, all disputes must be brought solely in an individual capacity.

Neither party shall participate in a class action, collective action, consolidated action, representative action, or private attorney general action.

Attorney’s Fees and Costs

In any arbitration, litigation, collection action, or proceeding arising out of or relating to these Terms, the prevailing party shall be entitled to recover its reasonable attorney’s fees, expert witness fees, arbitration costs, court costs, and other expenses incurred in enforcing its rights.

Equitable Relief

Notwithstanding the arbitration provisions above, Retrofit Supercharger, LLC may seek temporary, preliminary, or permanent injunctive relief, specific performance, or other equitable remedies in any court of competent jurisdiction to protect:

Intellectual property rights;
Confidential information;
Trade secrets;
Proprietary designs;
Product designs;
Trademarks; or
Website security.

21. GOVERNING LAW AND EXCLUSIVE VENUE

These Terms shall be governed by and construed under the laws of the State of Connecticut, without regard to conflict-of-law principles.

To the extent any dispute is permitted to proceed in court rather than arbitration, the parties agree that exclusive jurisdiction and venue shall lie in the state and federal courts located within Connecticut.

The parties expressly consent to the personal jurisdiction of such courts and waive any objection based on inconvenient forum or venue.

Any claim arising out of or relating to these Terms must be commenced within one (1) year after the cause of action arises, or such claim shall be permanently barred to the fullest extent permitted by law.

22. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

23. ENTIRE AGREEMENT

These Terms constitute the entire agreement between the parties regarding the Site and products sold by Retrofit Supercharger, LLC and supersede all prior agreements, communications, and understandings.
